TopStudio Software AS License Agreement And Limited Warranty \n\n1. ACCEPTANCE OF AGREEMENT\n\nYou agree that by installing, copying, or using in any other manner the Software accompanying this Agreement, you have agreed to be bound by the terms of this Agreement.\n\na) If you do not agree to the terms of this Agreement, you must return the Software with the diskette or CD/ROM (whatever applies) wrapping unopened, to the place from which you obtained the Software. You shall then receive a full refund from that place.\n\n2. COPYRIGHT\n\na) The Software is protected by copyright and intellectual laws and international copyright treaties.\n\nb) All title and copyrights in and to the Software (including all copies and all incorporated material) and to the accompanying documentation, is the property of TopStudio Software AS or its suppliers.\n\n3. YOUR RIGHTS:\n\na) You only receive a right to use the Software. TopStudio Software AS continues to own the Software.\n\nb) You may install and use the Software on a number of computers corresponding with the number of Licenses you have purchased.\n\nc) You may also install the Software on a network server, but use it only from the number of computers corresponding with the number of Licenses you have purchased.\n\nd) All users sharing the use of the Software on one particular computer, must have a separate license. If a user uses the Software on several computers, the user must have one separate license for each computer.\n\ne) You may not use the Software on computers that exceed the number of Licenses you have.\n\nf) You may make one copy of the software, provided that you archive either the copy or the original and use the other.\n\ng) You may only permanently transfer all of your rights under this Agreement if the receiver agrees to the terms of this Agreement, and if you retain no copies and transfers all of the Software, including upgrades and/or retained previous versions, the Certificate of Authenticity, printed materials and this Agreement.\n\nh) You may not reverse engineer, decompile, modify, translate and/or Disassembly the Software.\n\ni) You may not separate the components / parts of the Software from each other.\n\nj) You may not rent or lease the Software to others.\n\nk) If you buy an upgrade, you may use the upgraded software only in accordance with this Agreement.\n\nl) If you buy an upgrade, you may not use or transfer the previous version of the software.\n\n4. LIMITED WARRANTY\n\na) TopStudio Software AS warrants that the Software performs substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt.\n\nb) In case the Software does not meet the requirements of the Warranty, TopStudio Software AS may, at its sole discretion, and, provided that the Software is returned to TopStudio Software AS with a copy of your receipt, either\n\n - return of the price paid, or\n - repair or replace the Software.\n\nc) This warranty does not apply if the Software has been damaged as a result of accident, abuse, or misapplication. This warranty only applies if you have a legal copy of the software. A legal copy of the Software is a copy either sold in the original Top Studio Software packaging, or a copy installed on a computer purchased together with a Certificate of Authenticity for the Software.\n\nd) The warranty period for replacement Software the remainder of the original warranty period, or thirty (30) days, whichever is longer.\n\ne) The provisions of this article contain TopStudio Software AS's or its suppliers' entire liability and your exclusive remedies.\n\n5. TERMINATION\n\na) If you fail to comply with the terms and conditions of this agreement, TopStudio Software AS may terminate the Agreement.\n\nb) You shall, in case of a termination, destroy all copies of the Software and all of its component parts.\n\nc) The provisions of this article are without prejudice to any other rights that TopStudio Software AS may have.\n\n6. DISCLAIMER\n\na) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOPSTUDIO SOFTWARE AS AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED. THE DISCLAIMER INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE SOFTWARE PRODUCT.\n\nb) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOPSTUDIO SOFTWARE AS OR ITS SUPPLIERS SHALL IN NO EVENT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF TOPSTUDIO SOFTWARE AS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.\n\n7. LAW\n\nIn the event that a state or a jurisdiction has mandatory regulations that do not allow particular provisions contained in this agreement, those particular provisions shall apply only to the fullest legal extent or with the minimum requirements of the said law. Norwegian Law shall apply to this Agreement.\n
